  • Daejeon Public Bicycle “Tashu” - Service General Terms and Conditions for Unmanned Rental System

  • CHAPTER I GENERAL PROVISIONS

    Article 1 (Purpose)
    The purpose of this General Terms and Conditions is to define the requirements, procedure and other required matters on the service during the operation of the Tashu unmanned rental system of Daejeon public bicycle system (hereinafter referred to as the "Tashu").

     

    Article 2 (Notice of the General Terms and Conditions)
    ① This General Terms and Conditions shall have its validity by notifying to "members" and consented by "members".
    ② Contents of the General Terms and Conditions are posted through the "Service General Terms and Conditions" column when subscribing for membership, and in the event that the General Terms and Conditions is modified or partially revised, the Tashu operator institution notifies it through the "notice matter" of the homepage without delay.

     

    Article 3 (Compliance of the General Terms and Conditions)
    Matters not specified under this General Terms and Conditions are applicable for the provisions of pertinent laws and regulations, and if not, follow the general customs.

     

    Article 4 (Definitions)
    Definitions of terminologies used for this General Terms and Conditions shall be shown as follows.
    1. Member: Any person subscribed as a general member, regular (paid) member, and non-(daily) member of Tashu, the Daejeon public bicycle system, by agreeing to the General Terms and Conditions
    2. General (quasi) member: Any person subscribed as a member of "Tashu", the Daejeon public bicycle system, by agreeing to the General Terms and Conditions.
    3. Regular (paid) member: Any person acquiring the right to use Tashu after undertaking the fees paid for 7-day or longer by subscribed as the member by using the Tashu, the Daejeon public bicycle system, by agreeing to the General Terms and Conditions.
    4. Non-(daily) member: Any person yet to be subscribed officially as Tashu member even after acquiring the service right through mobile phone certification, payment, and T-money payment.
    5. Operator: An institution that comprehensively operates operation and management of Tashu, the unmanned rental system of Tashu, the Daejeon public bicycle system.
    6. Membership card: The transportation card granted for the service right to use the Tashu by user (credit card with T-Money or transportation card function)
    7. Password: Combination of English letters and numbers set by the member to protect the confidentiality of the membership card.
    8. Rented password: Combination of figures from 1 to 4 set by the member to protect the member rental certification.
    9. Public bicycle: The bicycle that is placed in the rental office to provide unmanned rental and return by facilitating the card.
    10. Rental office: The place to rent and return the Tashu without personal service.
    11. Bicycle stand: This is the place for parking of bicycle placed in the rental office to place and lock for the Tashu.
    12. Service: A series of action to obtain the approval to rent the Tashu in the rental office by member or non-member to use the Tashu and then return the applicable bicycle.
    13. Internet service: The service to provide information for members, terminal status search and others provided in connection with computer network nationwide.
    14. Fees for service use in membership system: The membership fee for the service right for each period designated by the operator at the time of subscribing for membership.
    15. Service fees: The Tashu rental charge designated by the operator

     

    CHAPTER II COMPLIANCE OF MEMBERS

    Article 5 (Application for Membership)
    ① Tashu is available for membership subscription by anyone who can operate a bicycle as age 15 or older.
    ② In the event that the membership subscription for Tashu is intended, link to the Tashu homepage on Internet to apply for membership application.
    ③ When preparing the membership subscription application, following information has to be filled in.
    1. Name
    2. Address (including the zip code)
    3. Home phone number
    4. Mobile phone number
    5. Resident registration number (Resident registration number of the person if the mobile phone is under someone else's name)
    6. E-mail address
    7. Homepage service ID, password
    8. Card number (credit card with the transportation card functions and others)
    (※ The membership card can be registered in accordance with the registration procedure of the kiosk and it is not registered in the homepage of Tashu.)
    ④ For any minor who is older than 15 but less than 19 years of age, membership subscription is granted upon completing the procedure for membership subscription of Tashu by the legal guardian.

     

    Article 6 (Reservation and Rejection of Membership)
    ① In the event that it is applicable as follows, the operator may reserve the consent of the membership application.
    1. In the event that there is a problem in the Tashu use due to the technical problem
    2. In the event that it is recognized by the operator as required for efficient operation of Tashu and others
    ② The operator may reject the membership application as applicable to the following.
    1. When the membership application is filed with the name of someone else;
    2. When the contents of the membership application are falsely listed;
    3. When the service application is made for the purpose of interfering with social welfare, order or norm;
    4. A minor who is older than 15 but less than 19 years of age without the consent of legal guardian
    5. In the event that the membership applicant is a minor of less than 15 years of age; or
    6. In the event that there is a material physical and mental cause not to use the Tashu.

     

    Article 7 (Modification of Membership Information)
    In the event that a member wishes to modify the following, it may link to the Internet homepage to modify the following matters.
    1. Home and mobile phone numbers
    2. Home address
    3. E-mail address
    4. Password

     

    CHAPTER III SERVICES

    Article 8 (Service Hours)
    ① The service hour shall be 24 hours (00:00~24:00) a day and all days around the year unless otherwise having special interference on operator's work and technology. However, the date or hour that the operator set forth due to the regular inspection and others shall limit its use.
    ② The rental hour per each time of Tashu shall be 1 hour and there is no restriction on rent and return frequency.
    ③ In the event that an hour of rent is exceeded, the service charge set forth by the operator shall be imposed.

     

    Article 9 (Service Charge)
    ① The membership subscription fee and service charge of Tashu shall be collected on the basis of the service charge that the operator established.
    ② The service charge for rental with exceeded service hour shall be collected through the request for small amount payment for the mobile phone.
    ③ Tashu may impose all repair expenses arising from the intentional or negligent facility damages on the user. Repairing expenses shall follow the ordinary price.
    ④ Expenses imposed as applicable to the above Paragraph ③ shall be imposed through separate notice, and when not paying for such expenses, strenuous sanction, such as, property garnishment, administrative litigation, and others, may be imposed.
    ⑤ All penalties and charges arising from the illegal act while using Tashu shall be paid by member or non-member rental user.

     

    Article 10 (Membership Card and Others)
    ① All responsibilities of management on member card and password shall be on members.
    ② With the exception of cases for clear cause, members shall not share, transfer or modify the member card.
    ③ All responsibilities on negligence of service use or unjust use by a third party arising from the member card shall be on members.

     

    Article 11 (Suspension and Termination of Membership Qualification)
    ① When the member wishes to terminate its qualification as a member, the termination application shall be made from the Tashu homepage.
    ② The operator may suspend and terminate the membership qualification without the advance notice in the event that it is applicable for the followings.
    1. In the event that the member card is shared with others or transfers to another;
    2. In the event that the operation of the Tashu service is intentionally interfered with;
    3. In the event that the operator determines as inappropriate as a member;
    4. In the event that it interferes with copyright or other rights of another user or a third party;
    5. Any person who is subscribed as a member in concealing the case of Article 6 (②);
    6. In the event that it neglects the case of Article 15 (Obligations and Responsibilities of Members); or
    7. In the event that it is determined as violating other pertinent laws and regulations.

     

    Article 12 (Refund of Subscription Fee following Withdrawal from Membership)
    ① Members may request to withdraw from the membership within 14 days from the date of service subscription. (However, it is within 7 days for 30-day membership)
    ② When there is a cause of refund of the subscription fee by the request of the member for withdrawal, the operator shall refund the entire subscription fee excluding the deduction amount set forth by the operator, and the expenses of payment fees and others required for refund processing shall be paid by the member for its own volition and the operator in the event that it is caused by service defect.
    ③ Refund of subscription fee shall be paid after receiving the consent of withdrawal of the member in principle, and in the event that there is no content of use, it shall be disposed as approval cancellation of the payment means (credit card, mobile phone and others), and in the event that there is a content of use, the deduction amount shall be excluded to process for account transfer deposit of the member. However, the repayment provision shall follow the regulations set forth by the operator. (Notification on homepage)

     

    Article 13 (Suspension and Restriction of Service Provision)
    ① The operator may suspend the service provision in the event that it is applicable to the followings.
    1. In the event that it is inevitable, due to repairing or working on service facilities;
    2. When the telecommunication company defined under the Telecommunications Business Act has suspended the electricity and communication service is suspended
    3. When there is interference to users due to national emergency, service facility with interference, or drastic increase in service use.

     

    Article 14 (Obligation of Operator)
    ① The operator shall have the responsibility and obligation to maintain and manage Tashu for convenient use by users.
    ② The operator shall not disclose or distribute the personal information of the members known in relation to the service provision without the approval of the member.
    ③ In the event that there is any modification or additional matter of the service content, the operator shall notify the matters on the internet homepage screen of Tashu.
    ④ The registered membership information shall be deleted from all data included in the operation server as soon as its withdrawal.

     

    Article 15 (Obligations and Responsibilities of Member)
    ① Members shall not undertake any of the following acts when using Tashu.
    1. Any act of renting or transferring the member card to a third party;
    2. Any act of returning the bicycle in a place other than the Tashu rental office;
    3. Any act of getting a person or animal other than the member on the bicycle;
    4. Any act of altering or/and modifying the Tashu for personal use of the member;
    5. Any act of running outside of administrative jurisdiction of Daejeon City;
    6. Any act of running the blocks barred for bicycle to run;
    7. Any commercial act by using the Tashu;
    8. Any act of using the information obtained by using the service for providing to third party or reproduction for purpose other than the use by members without advance approval of Daejeon City; or
    9. Any act that interferes with the use with the rights of copyright and others by other users or third party.
    ② Members shall comply with the following obligations and responsibilities when using Tashu.
    1. Members shall confirm the normal operation of the driving device and safety device of applicable Tashu before renting Tashu. The bicycle impossible for normal operation shall not be rented and it has to be contacted to the operation center.
    2. While stopping and parking Tashu in any place other than the rental office, members have to use the self-lock device and others attached on Tashu to be careful for theft.
    3. Members have to be careful for destruction and loss of Tashu during the Tashu rental and they have the responsibility on destruction and loss arising while using it.
    4. Members shall not rent Tashu in the event that they had excessive alcohol density in blood under the pertinent law, drinking and alcohol consumption before renting Tashu.
    5. Tashu is the bicycle for ordinary living and it shall not be used for the special purpose in racing, mountain biking, bicycle show or the like.
    6. On the basket attached in front of Tashu, it shall not place excessive weight to interfere the parallel maintenance and direction adjustment while running the bicycle.
    7. Upon the climate condition that may have the safety accident during the Tashu operation, the Tashu rental shall not be made.
    8. Tashu shall return the bicycle in the condition of renting other than the ordinary abrasion arising from riding after renting.
    ③ When having the following matters during the use of service, members shall notify it to the operator and the Tashu related institution of the operator.
    1. Any damage, loss and destruction of Tashu arising while renting;
    2. Any personal damage on member and third party arising while renting; or
    3. Loss and stolen of member card.
    ④ Members have to comply with the pertinent provisions of laws and General Terms and Conditions, service information and service related caution, matters notified by the operator and others.

     

    Article 16 (Prohibition to Raise Objection and Claim for Damage Compensation)
    ① Members shall not raise any application and civil complaint on any issue generated from mistake and negligence of members when using the Tashu service that the operator provided.
    ② Members shall not claim any damage compensation on the operator, related institution and related companies on any issue raised by mistake and negligence of members when using the Tashu service that the operator provided and the operator shall not be held liable for such result.

     

    SUPPLEMENTARY
    The General Terms and Conditions shall be applicable from July 1, 2012.
