Terms of Service

Terms and conditions of use of Daejeon Metropolitan City public bicycle “Tashu” Chapter 1 General Provisions Article 1 (Purpose) The purpose of these Terms and Conditions is to stipulate the conditions and other necessary matters regarding the use of the Tashu public bicycle unmanned rental system (hereinafter “Tashu”). Article 2 (Definition) The definitions of terms used in these Terms and Conditions are as follows. 1. Member: Customer who agrees to these terms and conditions, signs up as a member and uses Tashu 2. Operator: Daejeon Transportation Corporation, entrusted with the operation and management of Tashu by Daejeon Metropolitan City 3. Rental office: A place where you can rent and return Tashu. 4. Stand: A bicycle parking stand provided at the rental place to hold the Tashu. 5. Service use: A series of actions in which a member rents, uses, and returns Tashu at a rental office. 6. Usage fee: Usage fee set by the Daejeon Metropolitan City Bicycle Use Activation Ordinance. 7. Basic usage time: Basic usage fee time set by the Daejeon Metropolitan City Bicycle Use Activation Ordinance. 8. Additional usage fee: Fee to be paid when basic usage time is exceeded 10. Return: When the vehicle is placed at the rental office and the lock is locked according to the designated method. Article 3 (Rules other than Terms and Conditions) Matters not defined in these Terms and Conditions shall be governed by relevant laws and regulations, if any, and otherwise, general practices shall apply. Article 4 (Effectiveness and Change of Terms and Conditions) ① These Terms and Conditions become effective upon notice to members and their consent. ② The contents of these terms and conditions will be notified to members when registering as a member (or upon obtaining usage rights), and if the terms and conditions are changed, such changes will be announced for at least 7 days through the website, etc. The changed terms and conditions will take effect from the announced effective date. ③ If a member does not explicitly express his/her intention to reject the changed terms and conditions during the notice period, he/she is deemed to have agreed to the changed terms and conditions. If you do not agree to the revised terms and conditions, you may cancel (withdraw) your membership. Chapter 2 Member Compliance Matters Article 5 (Application for Membership) ① Anyone over the age of 15 and able to drive a bicycle can become a member. ② If you wish to sign up as a member, you must sign up as a member on the Tashu app. ③ When registering as a member, you must follow the identity verification process and enter the following required information. <Implementation January 7, 2025> 1. Name 2. Mobile phone number 3. Date of birth 4. Gender ④ Personal information must be entered in each item of paragraph 3, and must be updated if any changes occur. You may be penalized if you provide false information or do not update your information. ⑤ Those under the age of 15 cannot use the service, and if a minor under the age of 15 uses the service, disadvantages such as not being able to receive insurance coverage in the event of an accident may occur. (Article 732 of the Commercial Act) Accordingly, death insurance does not apply to children under 15 years of age.) Article 6 (Membership Suspension and Refusal) ① The operator may withhold membership approval in any of the following cases. 1. If there is a problem using Tashu due to technical issues 2. When the operator deems it necessary for efficient operation, etc. ② The operator may reject a request for membership registration in any of the following cases. 1. If you sign up for membership using someone else’s name 2. If registration information is falsely entered 3. If you register as a member for the purpose of disrupting social order and morals 4. Minors under 15 years of age 5. If there are serious physical or mental reasons that make it difficult to use Tashu. 6. Those whose membership has been canceled in accordance with these Terms and Conditions Article 7 (Change in Member Information) ① Members can view or modify their personal information on the Tashu app. However, personal information deemed necessary for service management cannot be modified. ② If there is a change in the information provided when applying for membership, the member must edit it in the Tashu app or notify the operator of the change by email or other means. ③ We are not responsible for any disadvantages arising from failure to notify changes in Paragraph 2. Chapter 3 Use of Services Article 8 (Service usage hours) ① The service usage hours are from 05:00 to 24:00 in accordance with the usage hours of the Daejeon Metropolitan City Bicycle Use Activation Ordinance, unless there is a special problem with the operator's work or technology. However, during the peak usage season from March to November, it is open 24 hours a day, and use may be restricted on days or times determined by the operator for reasons such as regular inspections. ② The rental time for each Tashu is 1 hour, and there is no limit to the number of rentals and returns. ③ If the one-time rental time exceeds 1 hour, an additional usage fee of 500 won per 30 minutes is charged in accordance with the Daejeon Metropolitan City Bicycle Use Activation Ordinance, and the maximum additional usage fee per day is 5,000 won. ④ If the bicycle is not returned due to the member's fault, an additional usage fee will be charged until the bicycle is returned properly. ⑤ If the rented bicycle is not returned beyond the normal usage time, it may be considered lost (theft) and reported as lost (theft). Article 9 (Payment of usage fee and ticket) ① Tashu usage fee is collected based on the usage fee set by the Daejeon Metropolitan City Bicycle Use Activation Ordinance. ② Additional usage fees incurred beyond the basic usage time will be charged through the payment method designated in advance by the user, and customers who have not paid the additional usage fee will be restricted from using the service until payment is made. ③ The Tashu operator may charge members for all repair costs incurred due to damage to facilities due to intention or negligence. Repair costs follow normal unit prices. ④ Fees imposed under paragraph 3 will be charged through a separate notice, and if non-payment is made, strong sanctions such as property seizure and administrative litigation may be imposed. ⑤ Fines and fees incurred due to illegal acts while using Tashu must be borne by the member. Article 10 (Suspension and Termination of Membership) ① If a member wishes to terminate his/her membership, he/she must apply for cancellation through the Tashu app. ② If a member violates use, the operator may impose sanctions without prior notice in accordance with Appendix 1. Article 11 (Refund and Payment Cancellation) ① Members may request a refund. Refunds are processed through payment cancellation if the service is not used (except in cases where payment cancellation is not possible after settlement has been completed). ② Costs such as payment fees incurred when processing a refund are borne by the member, and in the case of a defect in the Tashu service, the operator is responsible. Article 12 (Suspension and Restriction of Service Provision) The operator may suspend service provision in the following cases: 1. When maintenance, such as repair or maintenance of the shoe or facility, is required. 2. When a basic telecommunications business operator stipulated in the Telecommunications Business Act suspends telecommunication services 3. In case of disruption to members due to national emergency, service facility failure, or excessive service use, etc. Article 13 (Operator's Obligations) ① The operator has the obligation to maintain and manage Tashu so that citizens can conveniently use it. ② The operator will not disclose or distribute member personal information known in connection with the provision of services to a third party without the member's consent. However, in cases falling under Articles 17 and 18 of the Personal Information Protection Act, the information may be provided to a third party without the person's consent. ③ If there are any changes or additions to the service content, the operator will announce such information on the Tashu website screen. ④ Registered member information will be deleted immediately upon withdrawal. However, some information necessary for operation, such as rental history and payment history, is maintained. ⑤ The operator may force the return of un-returned Tashu, and may charge an excess fee (maximum daily usage fee) or restrict use by checking whether the return was normal. Article 14 (Member's Obligations) ① When using Tashu, members must not engage in any of the following acts. 1. Renting or transferring member information to a third party 2. Returning the bicycle to any location other than the Tashu rental office. 3. Bringing someone other than a member on board or having two or more people board at the same time. 4. Modifying and transforming Tashu for the member’s personal use. 5. Riding in areas where bicycle riding is prohibited 6. Commercial transactions using Tashu 7. Reproducing or providing information obtained using the service to a third party for purposes other than member use without prior consent from Daejeon Metropolitan City. 8. Acts that infringe upon the copyrights and other rights of other members or third parties. 9. Riding with animals or objects that cause harm to other users 10. Driving outside the Tashu service provision area (Daejeon City administrative district) 11. Unfairly violating the human rights of Tashu operators or intentionally interfering with operations (verbal language, assault, sexual harassment, obstruction of business, etc.) ② Before using Tashu, members must check and comply with the following matters, and the operator is not responsible for any problems arising from violation of these provisions. Additionally, use of Tashu can be restricted if necessary. 1. Before renting a shoe, members must check that the drive and safety devices of the shoe are operating normally. Bicycles that cannot be driven properly should not be rented. 2. When renting a bicycle and stopping or parking the bicycle in a place other than the rental place, members must be careful about damage, loss, or theft of the bicycle, and must take measures to prevent pedestrians from being harmed by the parked bicycle. 3. Members must be careful of damage or loss of the Tashu while renting it, and are fully responsible for any damage or loss that occurs during use. 4. Members must not rent Tashu if they have been drinking or taking drugs before renting Tashu or if their blood alcohol content exceeds the legal limit. 5. Tashu is a bicycle for general daily use and should not be used for special purposes such as racing, mountain climbing, or bicycle stunts. 6. Do not place excessive weight on the luggage basket attached to the front of the bike that interferes with maintaining parallelism and adjusting direction while riding the bike. 7. You must not rent a Tashu during weather conditions that may cause a safety accident while driving. 8. The shoe must be returned in the same condition it was in when rented, excluding general wear and tear caused by driving after rental. 9. The return of Tashu will be completed only after the rental office confirms whether the return was normal (via text message, etc.). If this is not confirmed (regardless of the function of the user's mobile phone), it may be processed as not returned. 10. For safety, it is recommended to wear personal safety equipment such as a hard hat. ③ Members must immediately notify the operator if any of the following matters occur while using the service. 1. Damage, damage or loss of bicycles, etc. that occurred during rental 2. Damage to members and third parties that occurs during rental ④ Before using the service, members must check and comply with relevant laws, terms and conditions, usage instructions, and service-related notices. Article 15 (Prohibition of objections and claims for damages) ① Members cannot raise objections or complaints regarding any problems arising from the member's mistakes or negligence when using the Tashu service provided by the operator. ② Members cannot claim damages from the operator, related organizations, or related companies for any problems arising from the member's mistakes or negligence when using the Tashu service provided by the operator, and the operator is not responsible for this. ③ Unlike Paragraph 2, an insurance claim can be made for accidents caused by defects in the bicycle during normal use of Tashu. In this case, the user must collect and submit proof of the accident. Supplementary provisions These terms and conditions apply from December 20, 2024. (Article 14, Paragraph 1, No. 11) - Episode 1: Warning - 2nd time: Suspension for 6 months - More than 3 times: Suspension for 12 months ④ In case of failure to comply with member obligations (Article 14, Paragraph 1, Items 2 through 9) - Episode 1: Warning - 2nd time: Suspension for 1 month - More than 3 times: Suspension of use for 6 months ⑤ If the operator determines that the member is unsuitable (Article 14, Paragraph 2) - Episode 1: Warning - 2nd time: Suspension for 1 month - More than 3 times: Suspension for 3 months ⑥ If you joined with hidden membership due to inappropriate membership qualifications (Article 6, Paragraph 2) - Forced withdrawal and suspension of use for 6 months ⑦ Intentional damage and private use of public bicycles - 1 time: Suspension for 6 months - 2nd time: Permanent suspension ⑧ If it is judged to be in violation of other relevant laws and regulations - Episode 1: Warning - 2nd time: Suspension for 1 month - More than 3 times: Suspension of use for 6 months
